Terms and Conditions

These Terms and Conditions (“Terms”) govern the provision of certification services by Cualis (“Cualis”, “we”, “our”, or “us”) to any organization (“Client”, “you”, or “your”) applying for or holding certification.

By applying for or using Cualis certification services, the Client agrees to be bound by these Terms.

  1. Scope of Services

Cualis provides certification services, which may include self‑assessment tools, third‑party verification, conformity assessment, surveillance activities, and compliance tracking against defined standards or schemes.

Certification attests that the Client demonstrated conformity with the applicable requirements within the defined scope and at the time of assessment only. Certification does not constitute a guarantee of future performance, ongoing compliance, product quality, service quality, or legal or regulatory compliance.

  1. Eligibility and Client Responsibilities

Cualis services are available to organizations of all sizes and industries, subject to applicability of the certification scheme.

The Client shall:

  • Provide complete, accurate, and truthful information at all times
  • Immediately notify Cualis of any significant changes that may affect certification, including changes in ownership, management, scope of activities, structure, or compliance status
  • Comply continuously with all certification requirements and these Terms
  1. Certification Process

Certification is subject to successful completion of the applicable assessment and verification activities, including submission of required documentation and evidence.

All certification decisions are made by Cualis personnel who are independent of the assessment activities. Certification may be subject to surveillance, reassessment, or additional verification activities during the certification cycle, as defined by the applicable scheme.

  1. Fees and Payments

All certification, verification, and related services are subject to applicable fees. Fees must be paid in full in accordance with invoicing terms prior to the issuance or continuation of certification.

Fees charged by Cualis are independent of certification outcomes and are not contingent upon the granting, maintaining, expanding, reducing, suspending, or withdrawing of certification.

  1. Validity, Maintenance, and Renewal of Certification

Unless otherwise specified, certifications issued by Cualis are valid for a period of three (3) years from the date of issuance.

Certification remains valid only while the Client:

  • Continues to meet certification requirements
  • Complies with these Terms
  • Successfully completes any required surveillance or renewal activities

Renewal requires completion of an updated assessment and is not automatic.

  1. Use of Certification Name, Mark, and Badge

Certified Clients may use the Cualis certification mark or badge solely in accordance with Cualis branding and usage guidelines and only for the certified scope and validity period.

The certification mark shall not be used:

  • In a misleading or deceptive manner
  • In a way implying certification of products, services, locations, or activities outside the certified scope
  • On products, product packaging, or product labels, unless explicitly permitted
  • After certification has expired, been suspended, or withdrawn

Cualis reserves the right to take corrective action for misuse of certification claims or marks.

  1. Confidentiality

Cualis shall treat all Client information obtained during certification activities as confidential and shall not disclose such information to third parties without consent, except where disclosure is:

  • Required by law or regulation
  • Required by accreditation or oversight bodies
  • Necessary for the operation of the certification scheme

Where permitted by law, Cualis will inform the Client prior to required disclosure.

  1. Impartiality and Independence

Cualis operates in accordance with the principles of impartiality, independence, and objectivity.

Cualis does not offer consultancy or advisory services that could compromise the impartiality of its certification activities. All identified risks to impartiality are managed in accordance with documented procedures.

  1. Appeals and Complaints

The Client has the right to submit appeals against certification decisions or complaints regarding Cualis activities.

All appeals and complaints are handled impartially, independently of the original activities, and in accordance with documented procedures. Submission of an appeal or complaint does not affect the Client’s obligation to comply with certification requirements.

  1. Suspension, Withdrawal, and Reduction of Certification

Cualis may suspend, withdraw, or reduce the scope of certification if the Client:

  • Fails to maintain compliance with certification requirements
  • Fails to resolve identified nonconformities
  • Misuses certification claims or marks
  • Fails to meet financial obligations
  • Provides false or misleading information

Upon suspension or withdrawal, the Client shall immediately cease all use of certification claims, references, and marks.

  1. Client Access and Verification Rights

The Client shall provide Cualis with access to all relevant records, personnel, sites (where applicable), and information necessary to verify continued conformity within the certified scope.

Failure to provide adequate access may result in suspension or withdrawal of certification.

  1. Public Information

Cualis may make publicly available information regarding the Client’s certification status, scope, and validity period in accordance with accreditation and scheme rules.

  1. Use of Subcontractors and External Personnel

Cualis may use qualified external auditors, assessors, or subcontractors to perform certification activities. Cualis retains full responsibility for all certification decisions and outcomes.

  1. Records Retention

Cualis retains certification records for periods consistent with applicable accreditation, legal, and scheme requirements.

  1. Limitation of Liability

Cualis shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of or reliance upon certification services.

Certification does not transfer risk or responsibility and does not relieve the Client of its legal, regulatory, contractual, or statutory obligations.

  1. Accreditation Status

Unless explicitly stated, certification issued by Cualis does not imply endorsement or approval by any accreditation body, regulator, or governmental authority.

  1. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, United States.

  1. Acceptance of Terms

By applying for, receiving, or maintaining certification, the Client acknowledges and agrees to abide by these Terms and Conditions.
